Two Judicial Decisions to Solicit the Assistance of Experts in the Cases of the Composting Plant in Costa Brava and Damascus Road project

Garbage Crisis

 

In the UFL follow up on the garbage file in Lebanon, especially the composting plant in the Costa Brava dump site, and one year following the court complaint brought by UFL and their partners before the prosecution, especially in the face of each of the Head of the Development and Reconstruction Counsel Nabil Al Jisr and contractor Jihad Al Arab in order to stop the implementation of the aforementioned plant due to the massive risk it poses to the citizens’ health, in addition to the toxic and unpleasant odors it releases in the vicinity of the airport, Judge Rola Chamoun, Interim Relief Judge in Aley, issued a decision to appoint an expert to examine the plant and the completed work, to find out whether the composting works going on in this plant have caused health or environmental damage of any kind or if it has caused damage to the visitors of Beirut airport, and determine the type of damage, its’ causes and ways to stop this damage or avoid it. The ruling also entails that the expert have access to the necessary documents and submit his report with a colored photograph within a one-week-period effective from the date of notification of the task.

Judge Rola Chamoun also issued a similar ruling today 16th of July 2020 to assign an expert in order to investigate the Damascus Road project, Aley-Souk Al Gharb conjecture, also against the background of the complaint presented by UFL on February 28, 2019 against contractors Jihad Al Arab and Raed Al Rayes for lack of the required conditions needed to implement the project and exposing public safety to massive danger.

This is a step on which the appropriate decision should be made, hoping that everything related to the garbage file in particular will be dealt with as an emergency which puts the Judicial system on alert to issue immediate rulings in order to preserve what’s left of the citizens’ health and security.
